GIFT CARD PURCHASE AND USE TERMS AND CONDITIONS

ESPA Rīga Spa Centre

1.General Provisions

1.1. A Gift Card is a cashless payment instrument issued by SIA “Viesnīca Latvija” (hereinafter – the Issuer) and may be used, within its validity period, to pay for services at the ESPA Rīga spa centre, Baznīcas Street 4A, Riga.
1.2. A Gift Card may be used once or multiple times until its full nominal value is exhausted or its validity period expires.
1.3. These Terms and Conditions govern the purchase, use and circulation of Gift Cards and are binding on all Gift Card purchasers and users.

2. Types of Gift Cards

2.1. ESPA Rīga offers the following types of Gift Cards:

  • Gift Card for a specific treatment (paper format)
  • Invitation to the Active Recreation Zone or Active Recreation Zone + Thermal Complex (paper format)
  • Gift Card with a freely chosen nominal value (EUR 15–150) in plastic format
  • Electronic (PDF) Gift Card with a nominal value (EUR 15–200)
  • Electronic (PDF) Gift Card for a specific service

2.2. Gift Cards are issued in euros (EUR) and with a specified validity period.

2.3. The design of the Gift Cards and the information displayed on them is determined by the Issuer.

3. Purchase of Gift Cards

3.1. Gift Cards may be purchased:

  • on the website www.espariga.com
  • in person at the administration of the ESPA Rīga spa centre.

3.2. A Gift Card is issued after full payment has been received.
3.3. Once issued, the nominal value of a Gift Card may not be changed or topped up.

4. Right of Withdrawal

4.1. The purchaser has the right to withdraw from the contract within 14 days from the date of purchase of an electronic Gift Card, provided that the Gift Card has not been used.
4.2. The right of withdrawal does not apply to:

  • paid services or visits scheduled for a specific date or time period;
  • cases where the consumer has expressly agreed to the commencement of service performance and waived the right of withdrawal.

4.3. A withdrawal request must be submitted by contacting ESPA Rīga using the contact details provided on the website.

5. Transfer of Gift Cards

5.1. A Gift Card may be freely transferred to third parties.
5.2. The lawful user of a Gift Card shall be deemed to be the person in whose possession the Gift Card actually is.
5.3. The Issuer and the service provider are under no obligation to verify the legal basis on which the Gift Card was obtained.

6. Use of Gift Cards

6.1. A Gift Card may be used by any person within its validity period and available balance.
6.2. If the balance of the Gift Card is insufficient, the remaining amount may be paid using another available payment method.
6.3. Gift Cards may not be exchanged for cash, and any remaining balance is not payable in cash.

7. Validity Period and Extension

7.1. The standard validity period of a Gift Card is 12 months from the date of purchase, unless otherwise indicated on the Gift Card.
7.2. Gift Cards for the Active Leisure Zone or the Active Leisure Zone and Thermal Complex are generally valid for 6 months, unless otherwise indicated on the Gift Card.
7.3. A Gift Card may be extended once, for up to 3 months, by submitting a request no later than 3 months after the expiration of the validity period and paying an extension fee of EUR 10.00.
7.4. After the extended validity period expires, the Gift Card becomes invalid.

8. Damaged and Lost Gift Cards

8.1. Damaged Gift Cards may be replaced if the Gift Card can be properly identified.
8.2. Lost, stolen or otherwise unlawfully obtained Gift Cards are not restored or blocked.

9. Liability

9.1. The Issuer is responsible for the issuance, validity and technical operation of the Gift Card within the scope of these Terms and Conditions and applicable laws and regulations.
9.2. The quality, scope, safety and conformity of services paid for using a Gift Card are the responsibility of the respective service provider in accordance with the laws of the Republic of Latvia.
9.3. The Issuer shall not be liable for losses resulting from the loss, theft, unlawful use or damage of a Gift Card, unless such losses have arisen due to the fault of the Issuer.
9.4. The Issuer’s liability for losses related to the use of a Gift Card shall be limited to the unused balance of the respective Gift Card, except where otherwise provided by applicable law.
9.5. Nothing in these Terms and Conditions limits the consumer’s rights granted under the Consumer Rights Protection Law.

10. Complaints

10.1. Complaints regarding the use of a Gift Card or transactions related thereto must be submitted in writing within 30 days from the date of the relevant transaction or receipt of information.
10.2. The Issuer shall review the complaint and provide a response within 10 business days.
10.3. If a dispute cannot be resolved amicably, the consumer has the right to refer the matter to the Consumer Rights Protection Centre or to court.

11. Personal Data Protection

11.1. Personal data are processed in accordance with applicable laws and regulations and the ESPA Rīga Privacy Policy.

12. Final Provisions

12.1. These Terms and Conditions shall be governed by the laws of the Republic of Latvia.
12.2. The Issuer reserves the right to amend these Terms and Conditions by publishing the updated version on the website.
